Terms of Service

Straightforward terms for working with Buildwise — what we do, what we ask of you, and how we protect both sides.

These Terms of Service ("Terms") govern your use of buildwise.studio and any services provided by Buildwise, operated by David Molina in Chino Hills, California. By using the site or hiring us, you agree to these Terms. If you don't agree, please don't use the site or engage our services.

Buildwise designs, builds, and maintains websites for businesses. Specific deliverables, timelines, and pricing for a given project are agreed in a separate written proposal or invoice, which — together with these Terms — forms the full agreement.

Every project includes a required monthly care plan covering hosting, backups, updates, and support. Details are outlined in your proposal.

  • 50% deposit is due to kick off any project.
  • Remaining 50% is due upon project completion and before final launch.
  • Monthly care plan is billed on a recurring basis and required to keep your site online.
  • Late or unpaid invoices may result in the site being taken offline until the account is current.

All fees are non-refundable once work has begun, except as required by law.

To keep your project on track, you agree to:

  • Provide accurate content, photos, and information in a timely manner.
  • Own or have the right to use anything you provide (text, images, logos).
  • Review deliverables and respond to feedback requests promptly.
  • Use your website lawfully and not for illegal, harmful, or misleading purposes.

Once your project is paid in full, you own the final custom design and content of your website. Buildwise retains ownership of any underlying frameworks, templates, code libraries, or tools used across multiple client projects.

Buildwise may display your completed project in its portfolio and marketing materials unless you request otherwise in writing.

Each package includes a defined number of design revisions specified in your proposal. Work that falls outside the agreed scope (new pages, additional features, redesigns after approval) will be quoted as an add-on before any work begins.

We build every site with care, but the site and services are provided "as is" and "as available." To the fullest extent permitted by law, Buildwise disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee specific results, search rankings, conversion rates, or business outcomes.

To the maximum extent permitted by law, Buildwise and David Molina will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

Our total liability for any claim arising from these Terms or your use of the services will not exceed the amount you paid us in the three (3) months before the claim.

You agree to defend and hold Buildwise harmless from any claims, damages, or expenses (including legal fees) arising from content you provide, your use of the services, or your violation of these Terms.

Either party may end an ongoing engagement with written notice. If you cancel mid-project, you're responsible for the portion of work completed to that point. If you cancel your monthly care plan, we may take your site offline.

We may suspend or terminate service immediately for non-payment, abusive behavior, or misuse of the services.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Bernardino County, California.

We may update these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the site or services after changes constitutes acceptance of the updated Terms.
